I saw little more than a sampling of the Q&A at the Alito hearings today, but it sure seemed like Sammy was trying to rope-a-dope Senators on the subject of the “unitary executive.” He consistently failed to answer direct questions directly, falling back on clichés like “no one is above the law” and “the President must act within the limits of the Constitution.” But that’s precisely the issue.
