Scalito--The Issues

The Sunday NY Times editorial highlights what's at stake:

  • Restraints on presidential power- In my humble opinion, this is the big issue. Alito has championed the concept of the "unitary executive," a doctrine that, barring impeachment, places the presidency beyond the reach of Congress and the courts.
  • Abortion rights- Alito has on several occasions expressed his desire to see Roe overturned. The Religious Reich recognize this, which is one of the main reasons they so vociferously support him.
  • Civil rights- Sammy boy credits Warren Court decisions with driving him toward a conservative judicial career. These decisions cover bedrock principles of modern American democracy such as "one person-one vote" and "'separate but equal' = inherently unequal".
  • Toothless Congress- Alito would tell Congress it has no right to regulate machine guns or used car dealers who roll back odometers.
  • Individual vs. Corporate rights- Scalito has consistently sided with business against the little guy.
  • Workplace safety- Bye-bye OSHA.
In short, Scalito is a Tory who wants to roll back the clock to some time prior to July 4, 1776. If he's confirmed, we may really wind up with King George III all over again.
